Abu Dhabi Family, Civil and Administrative Cases Court ordered a man to pay Dhs61,000 to a woman from whom he had taken a loan of Dhs71,000 to establish his own company and he refused to return it.In detail, a woman filed a lawsuit against a man, requesting that he be ordered to pay her Dhs61,000, in addition to case fees and expenses.The plaintiff explained that the defendant had asked her for Dhs71,000 as a loan to establish his own company, and she had given him the amount to help him.She added that after more than four years he had paid Dhs10,000 but refused to repay the remaining amount despite her numerous demands.She added that she had offered him to repay half the amount at that time due to her need for money, but he ignored her request, which caused her harm.The defendant stated that the plaintiff was the one who requested to include her son as a partner in his private project specialising in clothing supply, and she gave him the amount based on trust.However, he added, the project failed, and after that, she asked him to return the amounts but due to his financial circumstances, she waived half the amount, and accordingly, he paid Dhs10,000, leaving Dhs25,000 owed to her.The judge directed the decisive oath to the plaintiff to swear that she had lent the defendant Dhs71,000 to help him with his business project, on the condition that he would return the amount, but he only returned Dhs10,000, and that she is demanding he pay Dhs61,000, so she took the oath.The court clarified that the decisive oath settled the dispute, and the defendant did not provide any evidence that he paid all of the amount. Therefore, the court ordered him to pay her Dhs61,000.
